Guest WiFi Wireless Networking Acceptable Use Policy

Festival WiFi Guys (the “Company”) offers this guest WiFi wireless Internet service (the “Service”) as a paid, non-public service to its visitors for the duration of their official visits at events and festivals, subject to this Guest WiFi Wireless Networking Acceptable Use Policy (the “Policy”). By logging into the Service, all users agree to be legally bound by the terms of this Policy and the Festival WiFi Guys Privacy Policy, available at https://festivalwifiguys.com/privacy-policy. We do not guarantee the Service, specific rates of speed, or uninterrupted access. We have no control over information obtained through the Internet and cannot be held responsible for its content, accuracy, or security. Use of the Service is at the user’s own risk.

Acceptable Use

We reserve the right to remove, block, filter, or restrict by any means any material or activity that, in our sole discretion, may be illegal, may subject us to liability, or may violate this Policy. We may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Violations of this Policy may result in the suspension or termination of access to the Service, legal action, or other remedies as detailed below.

Responsibilities of Service Users

Users are responsible for:

  • Ensuring their wireless devices run up-to-date anti-virus software to protect against worms, viruses, Trojan horses, and other threats.

  • Understanding that wireless Internet access, including this Service, is inherently not secure. Users should adopt appropriate security measures, such as avoiding confidential transactions (e.g., online banking, credit card transactions) over the Service.

  • Respecting all copyrights. Downloading, sharing, or distributing copyrighted materials without permission is strictly prohibited.

  • Refraining from activities that degrade network performance or accessibility, such as running programs, services, or servers that consume excessive resources.

  • Not engaging in prohibited activities, including but not limited to:

    • Sending electronic chain letters, mail bombs, or emails containing viruses or malicious software.

    • Accessing another person’s computer, account, files, or data without permission.

    • Attempting to circumvent or subvert system or network security measures.

    • Creating or running programs designed to identify security loopholes, decrypt secured data, or gain unauthorized access.

    • Using any means to decode restricted passwords or access control information.

    • Forging the identity of a user or machine in electronic communications.

    • Saturating network or computer resources, such as through denial-of-service attacks or excessive traffic (e.g., large file downloads like CD ISO images).

    • Connecting to “Peer to Peer” file-sharing networks or downloading large files that strain network capacity.

    • Accessing websites containing material that is obscene, libelous, defamatory, or promotes bigotry, racism, or hatred.

Users are solely responsible for the security of their devices and any actions taken from their devices, whether intentional or unintentional, that affect other devices or users of the Service.

Data Collection and Privacy

By using the Service, you consent to the collection, use, and sharing of your personal information as described in our Privacy Policy (https://festivalwifiguys.com/privacy-policy). This includes:

  • Device Fingerprinting: To verify which device is linked to a verify which device is linked to a WiFi purchase and enhance your experience, we collect detailed device information (e.g., device type, browser version, screen resolution, operating system details, and other technical identifiers) to create a unique device fingerprint. This information is used solely to recognize devices associated with your purchases, ensure secure access to our network, and provide a seamless user experience. We do not use device fingerprinting data for any other purpose.

  • Other Data: We may collect additional data, such as IP addresses, MAC addresses, and usage data, to provide and improve the Service, as detailed in our Privacy Policy.

  • Data Sharing: We do not currently sell your personal information. However, we may share anonymized or aggregated data in the future for business purposes, such as analytics or marketing, and will provide you with the opportunity to opt-out, as outlined in our Privacy Policy.

Children’s Usage

The Service is not intended for use by children under 13 without verifiable parental consent, in accordance with the Children’s Online Privacy Protection Act (COPPA). Limitations of Wireless Network Access

We are not liable for any damage, undesired resource usage, or detrimental effects to a user’s device or software while connected to the Service. Users release Festival WiFi Guys from liability for any loss, damage, security infringement, or injury sustained as a result of using the Service. Users are solely responsible for any such loss, infringement, damage, or injury, whether caused intentionally or unintentionally.

Lawful Use

The Service may only be used for lawful purposes and in a manner consistent with the rights of other users. The Service shall not be used to:

  • Violate any local, state, federal, or international law.

  • Infringe any copyright, trademark, trade secret, right of publicity, privacy right, or other right of any person or entity.

  • Access, transmit, or store material that is obscene, libelous, defamatory, or promotes bigotry, racism, or hatred.

  • Engage in negligent or malicious actions, such as sending emails with viruses or accessing websites that defame, abuse, or threaten others.

Illegal acts may subject users to prosecution by authorities, and we may pursue legal action to enjoin violations or recover damages caused by violations.

Terms of Service

By logging into the Service, users agree to comply with and be legally bound by this Policy and the Privacy Policy. If any terms are unacceptable, the user’s only recourse is to terminate use of the Service. Continued use of the Service constitutes acceptance of these terms.

Changes to Service and Policy

We reserve the right to modify the Service, its features, or this Policy at any time without prior notice. Material changes to this Policy will be communicated via a notice on our website or by email to the address associated with your account at least 30 days before the changes take effect, unless immediate changes are required by law. Continued use of the Service after such changes constitutes acceptance of the revised Policy.
